The bid decision I picked was matter of Choctaw Staffing Solutions. There was a contract open to an agency that provided support to Domestic abuse victims and they wanted to venture out across the US Military government facilities. There are multiple offers put up, and a contractor who put in for the bid seems to think the decision was unfair. The contract was given to the contractor who would offer the government the most with their proposal. The contractor who was granted the bid was assessed by past performances. Choctaw Staffing Solutions think the Military didn’t assess their performance fairly. I picked this decision because I was curious about the process of bidding and up against plenty of other contractors. There are multiple contracts, and they pick one who you think you should not have been selected. Yes, their proposal offer was good, but do they have what it takes? Domestic Violence is a topic that people try and hide, but it is out there and victim’s voices need to be heard.

Do you accept the proposal? Why or why not? What are the potential negative consequences either way?

Yes, if it was the only proposal received per FAR 15.208(b)(1)(iii) which states, it could be accepted. Otherwise, it could not be accepted because it missed the time submission deadline and it does not meet any of the other acceptable submission parameters, i.e., FAR 15.208(b)(1)(ii) …will not be considered unless it is received before award is made, the contracting officer determines that accepting the late proposal would not unduly delay the acquisition; and—

(i) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of proposals;

The potential negative consequences of not accepting this proposal are that this proposal could be the best proposal in terms of cost and provisions, the team could bring other technical intelligence that might not otherwise be found, and it might lead this firm to no longer participate in the solicitation process which would reduce competition for the Government.

The potential negative consequences of accepting the proposal are that it will set the precedent for any other solicitation deadline to be challenged and open up the flood gates for every responder to call agencies persistently to speak to them about their intent to submit responses and submit them after the deadline.
